EPA Proposes Ending DEF Derates

The EPA has proposed a major change that could bring long-awaited relief to truck fleets, farmers, diesel equipment operators, and anyone else who has ever watched a perfectly capable machine turn into a 5-mph lawn ornament because a DEF system got cranky.

The agency announced a new proposal that would eliminate engine deratements and vehicle speed restrictions tied to Diesel Exhaust Fluid system failures on newly manufactured highway trucks, nonroad engines, agricultural equipment, and other diesel-powered machines. Instead of forcing a truck or tractor into sudden reduced power mode, the proposed rule would allow operators to keep working while receiving visible or audible alerts that the problem needs to be addressed.

In other words, the truck would still tell you something is wrong. It just would not immediately respond by acting like it has taken a vow of silence and entered retirement on the shoulder of I-80.

For fleets, this is potentially a very big deal.

DEF systems are designed to help reduce nitrogen oxide emissions from diesel engines. That part is not going away. The EPA says the proposal would maintain the underlying emissions standards, including nearly 90% of the expected NOx reductions, while revising compliance requirements that the agency now describes as unnecessarily costly or difficult to implement.

The most eye-catching number in the announcement is the EPA’s estimate that the changes could save American truckers up to $12 billion. The agency also says savings could reach up to $6,000 per vehicle on new truck purchases, largely by scaling back certain emissions warranty requirements and giving manufacturers more time to meet longer useful-life standards.

That matters because warranty costs, compliance timelines, and emissions technology requirements do not exist in a vacuum. They eventually show up in vehicle prices, maintenance budgets, downtime, and the always-popular “why is this truck not moving?” conversation between operations and maintenance.

The proposal also addresses one of the trucking industry’s loudest and most persistent complaints: DEF-related derates.

For years, drivers and fleet managers have dealt with scenarios where a DEF sensor, dosing issue, or system fault could force a vehicle into reduced power or severe speed restriction. Sometimes the problem is serious. Sometimes it is a sensor issue. Sometimes it happens in exactly the wrong place, because apparently heavy-duty equipment has a flair for drama.

From a safety and productivity standpoint, sudden derates have always been hard to defend. A warning light is one thing. A loaded tractor-trailer suddenly losing road speed is another. The EPA’s proposed approach would shift the response from forced derate to operator alert, giving fleets time to get the issue repaired without instantly turning a revenue-generating asset into an expensive traffic cone.

The proposal also includes several other major pieces.

First, EPA is proposing to scale back certain emissions warranty requirements that it says created the largest single cost burden for the trucking industry. Second, the agency is proposing additional lead time before longer regulatory useful-life requirements from the 2023 heavy-duty emissions rule take effect. The stated goal is to allow manufacturers more time to make sure new technologies are reliable in real-world service instead of rushing them into the market before they are fully ready.

That last point will probably sound familiar to anyone who has ever bought the first model year of anything complicated and then involuntarily joined the product-development team.

EPA is also proposing nonconformance penalties for certain heavy-duty diesel engines that temporarily cannot meet upcoming NOx standards. That would allow manufacturers to continue selling engines during the transition period, while paying penalties if they fall short of the standard. The idea is to prevent supply disruptions and avoid putting fleets in a position where compliant equipment is either unavailable, unaffordable, or both.

For truck and engine manufacturers, this proposal could provide more flexibility. For fleets, it could mean less risk of truck shortages, fewer cost spikes, and a more practical path to newer equipment. For maintenance departments, it may eventually mean fewer late-night DEF-related emergencies, although nobody should get too excited. There will always be something. It is still trucking.

Importantly, this is not final yet.

EPA plans to hold a 45-day public comment period and a public hearing. That means fleets, manufacturers, dealers, repair providers, farmers, and other diesel equipment operators will have a chance to weigh in before the rule is finalized.

The agency is also taking public comment on whether guidance should be developed to allow manufacturers to apply similar derate-related changes to existing on-road and nonroad engines and equipment. That may be the part many fleets watch most closely, because the trucks causing problems today are, inconveniently, already in service.

For now, the proposal signals a major shift in how regulators may handle DEF system failures going forward. Instead of using sudden power loss as the enforcement hammer, EPA appears to be moving toward a warning-based approach that keeps equipment operating while still requiring the problem to be fixed.

For an industry built on uptime, that is not a small change. It could mean fewer roadside disruptions, lower costs, more predictable operations, and a little less time spent explaining to customers that their delivery is late because a sensor had feelings.

And for once, that might be a regulatory update fleet operators actually want to read.
